TERMS AND CONDITIONS OF USE

Version: 2.0

Effective Date: 14 October 2026

Website: https://aerocruitment.com

Legal Contact: legal@aerocruitment.com

IMPORTANT NOTICE

Please read these Terms and Conditions carefully before registering for, accessing, or using the Aerocruitment platform.

These Terms govern your access to and use of Aerocruitment, including its website, applications, software, communication tools, recruitment services, professional profiles, document-sharing facilities, credential verification features, subscriptions, and earnings programmes.

By registering an account, accepting these Terms electronically, purchasing a subscription, submitting a professional profile, uploading documentation, posting a vacancy, accessing candidate information, or otherwise using the Platform, you acknowledge that you have read and understood these Terms and agree to be bound by them, subject to applicable law.

If you do not agree to these Terms, you must not register for or use the Platform.

Certain features may be subject to additional terms, consent requirements, pricing conditions, or policies. Where applicable, those additional terms form part of your agreement with Aerocruitment.

Nothing in these Terms excludes or restricts any consumer, privacy, employment, aviation safety, or other legal right or obligation that cannot lawfully be excluded or restricted.

SECTION 1 — DEFINITIONS AND INTERPRETATION

For the purposes of these Terms, the following definitions apply.

1.1 "Aerocruitment", "Company", "we", "us", or "our" means the legal entity that owns and operates the Aerocruitment platform, identified in Section 26.

1.2 "Platform" means the Aerocruitment website, applications, APIs, databases, recruitment tools, professional profiles, document-sharing facilities, communication systems, payment facilities, verification features, and associated digital services.

1.3 "User" means any individual or organisation accessing or using the Platform, including Aviation Professionals, Employers, Recruiters, and visitors.

1.4 "Aviation Professional" or "Crew Member" means a pilot or other aviation professional who creates a profile, submits professional information, seeks employment opportunities, or participates in an earnings programme through the Platform.

1.5 "Employer" means an airline, aircraft operator, aviation company, aircraft owner, corporate flight department, or other organisation seeking to identify, assess, recruit, or engage Aviation Professionals.

1.6 "Recruiter" means an individual or organisation authorised to source, assess, introduce, or recruit candidates on behalf of an Employer.

1.7 "Candidate Documentation" means documents or records submitted by or relating to an Aviation Professional, including CVs, pilot licences, type ratings, medical certificates, logbooks, flight-hour records, training certificates, employment histories, identity documents, work authorisations, and other professional credentials.

1.8 "Profile" means a User's account page, professional information, employment history, qualifications, documents, preferences, and other information made available through the Platform.

1.9 "Unlock" means an eligible transaction through which an Employer or Recruiter obtains access to a Crew Member's previously restricted contact information or other designated information in accordance with the Platform's functionality and applicable pricing.

1.10 "Subscription" means a paid plan granting access to designated Platform features for a specified billing period.

1.11 "Earnings" means amounts credited to a Crew Member's earnings wallet under the earn-per-unlock programme.

1.12 "Privacy Policy" means the policy explaining how Aerocruitment collects, uses, stores, discloses, and otherwise processes personal information.

1.13 "Applicable Law" means the laws, regulations, binding regulatory requirements, and legally applicable obligations governing a User, Aerocruitment, or a particular activity.

1.14 "Third-Party Service" means an external website, software provider, payment processor, verification provider, regulatory database, or other service not owned or controlled by Aerocruitment.

1.15 Interpretation

  • Headings are provided for convenience and do not affect interpretation.
  • References to a person include individuals and legal entities where appropriate.
  • Where these Terms refer to permissions, obligations, or restrictions, they operate only to the extent permitted by Applicable Law.

SECTION 2 — ACCEPTANCE AND ELIGIBILITY

2.1 Acceptance

  • These Terms constitute an agreement between Aerocruitment and each User.
  • By using the Platform, you confirm that you understand the nature of the service and agree to comply with these Terms and any applicable additional policies.
  • Where required by law, Aerocruitment will obtain specific consent or acceptance separately rather than relying solely on continued use of the Platform.

2.2 Eligibility

You must be at least 18 years old, or the applicable legal age of majority if higher, and have the legal capacity to enter into an agreement.

2.3 Corporate Users

  • If you register or use the Platform on behalf of an organisation, you represent that you have the necessary authority to bind that organisation to these Terms.
  • References to an Employer or Recruiter may include the organisation on whose behalf the individual User is acting.

2.4 Accuracy of Information

  • All information submitted to the Platform must be accurate, current, complete, and not misleading.
  • Users must promptly correct material inaccuracies in their accounts and profiles.

2.5 Additional Policies

These Terms incorporate the Privacy Policy at https://aerocruitment.com/Privacy and the pricing and feature conditions clearly presented before the relevant purchase or participation. Additional policies bind a User only where made available and expressly incorporated before acceptance.

Mandatory law prevails. Specific transaction terms govern their stated subject matter, but do not expand document-sharing permissions under Section 8 or reduce privacy protections without the necessary notice and authorisation. These Terms otherwise govern Platform use. The Privacy Policy explains personal-information processing; neither document creates a lawful basis where Applicable Law requires a separate basis or condition.

An inconsistency must not be interpreted as permission for a wider use or disclosure of personal information.

SECTION 3 — NATURE AND PURPOSE OF THE PLATFORM

3.1 Online Aviation Recruitment Marketplace

Aerocruitment operates an online platform designed to connect Aviation Professionals with Employers and Recruiters.

The Platform may provide:

  • Professional profiles and CVs.
  • Candidate search and discovery tools.
  • Job vacancy listings.
  • Employer and Recruiter accounts.
  • Contact-information unlocking facilities.
  • Candidate document access and sharing.
  • Credential verification features.
  • Recruitment-related communication tools.
  • Paid subscriptions and premium profile features.
  • An earn-per-unlock programme.
  • Other aviation career and recruitment services.

The features available may change over time.

3.2 Intermediary Role

  • Unless Aerocruitment expressly agrees otherwise in a separate written agreement, Aerocruitment operates as a technology platform and recruitment marketplace.
  • Aerocruitment does not itself employ Aviation Professionals, operate aircraft, exercise operational control over aircraft, or make hiring decisions on behalf of Employers.
  • Aerocruitment does not act as a civil aviation authority, licensing authority, medical examiner, or aviation safety regulator.
  • The Company does not hold itself out as providing regulated recruitment, staffing, employment, or aviation services where it lacks the required authorisation.

3.3 Independent Parties

  • Employers, Recruiters, and Aviation Professionals act independently when using the Platform.
  • Employment offers, interviews, contract negotiations, employment agreements, remuneration arrangements, working conditions, and hiring decisions are determined by the relevant parties.
  • Unless expressly agreed in writing, Aerocruitment is not a party to employment or contractor agreements formed between Users.

3.4 No Guarantee of Outcomes

Aerocruitment does not guarantee:

  • That an Aviation Professional will obtain employment.
  • That an Employer will identify a suitable candidate.
  • That an Employer will respond to an application or enquiry.
  • That a vacancy will remain available.
  • That a vacancy will result in an interview, offer, or appointment.
  • That an employment offer will lead to a signed contract.
  • That an employment contract will be honoured by the parties.
  • That an Employer will remain financially solvent or continue operating.
  • That advertised remuneration, benefits, accommodation, visa arrangements, or working conditions will ultimately be offered.
  • That a particular number of candidates, vacancies, introductions, or commercial opportunities will be generated.

Users remain responsible for evaluating opportunities and making independent decisions.

3.5 No Operational or Regulatory Endorsement

  • The availability of an Employer, vacancy, profile, document, or verification badge does not constitute regulatory approval, safety certification, or an endorsement by Aerocruitment.
  • Users must not represent that Aerocruitment has approved or certified an individual or organisation unless the Company has expressly authorised that representation in writing.

SECTION 4 — USER ACCOUNTS AND SECURITY

4.1 Account Registration

  • Certain Platform features require an account.
  • Users must provide the information reasonably required for registration, account administration, security, and lawful operation of the Platform.
  • Aerocruitment may require additional information to establish account authenticity or eligibility for particular features.

4.2 Account Security

Users are responsible for:

  • Maintaining the confidentiality of their login credentials.
  • Using reasonable security measures to protect their accounts.
  • Not sharing passwords or authentication credentials with unauthorised persons.
  • Promptly notifying Aerocruitment of suspected account compromise.
  • Cooperating with reasonable security and account-recovery procedures.

Users must not knowingly permit another person to impersonate them or misuse their accounts.

Responsibility for activity under an account will be determined in accordance with Applicable Law and the circumstances, including whether the activity resulted from a User's conduct, negligence, or a security failure attributable to Aerocruitment.

4.3 Account Verification

  • Aerocruitment may implement identity, email, business, or other verification procedures.
  • Completion of an account verification procedure does not guarantee the User's honesty, qualifications, financial standing, or suitability for recruitment.

4.4 Account Accuracy

  • Users must update their information when material changes occur.
  • Aerocruitment may request clarification or supporting evidence where information appears inaccurate, incomplete, inconsistent, or potentially fraudulent.

4.5 Multiple Accounts

  • Users must not create or operate multiple accounts to manipulate the Platform, evade fees, circumvent access restrictions, inflate activity, or obtain unauthorised access to information.
  • Aerocruitment may permit multiple accounts where reasonably required for legitimate organisational purposes.

SECTION 5 — AVIATION PROFESSIONAL RESPONSIBILITIES

5.1 Accurate Professional Information

Aviation Professionals warrant that the information they submit about their qualifications and experience is accurate to the best of their knowledge.

This includes:

  • Total flight hours and flight-hour breakdowns.
  • Aircraft types and type ratings.
  • Pilot licences and ratings.
  • Medical certification status.
  • Training and examination records.
  • Employment history.
  • References and professional achievements.
  • Availability and employment preferences.
  • Work authorisation, where relevant.

5.2 Authentic Documentation

Aviation Professionals must not upload forged, misleadingly altered, unlawfully obtained, or unauthorised documents. Users must have the legal right to submit them.

Clearly identified redactions of irrelevant personal or confidential information are permitted if they do not misrepresent qualifications, validity, authenticity or suitability. Recipients may request an appropriate lawful verification process where redactions prevent a necessary check.

5.3 Changes to Qualifications

  • Aviation Professionals must promptly update or correct material information when a licence, rating, medical certificate, or other qualification expires, is suspended, is revoked, or otherwise changes status.
  • Where a profile displays a qualification that is no longer valid, the User must not knowingly permit the profile to continue misleading prospective Employers.

5.4 No Misrepresentation

Aviation Professionals must not misrepresent:

  • Their experience or flight hours.
  • Their professional competence.
  • Their licence or medical status.
  • Their employment history.
  • Their availability.
  • Their right to work.
  • Their references or professional endorsements.

5.5 Responsibility for Applications

  • Aviation Professionals are responsible for reviewing employment offers, verifying Employers, assessing contractual terms, and obtaining independent legal, financial, or professional advice where appropriate.
  • Aerocruitment does not guarantee that an opportunity is suitable for a particular User.

5.6 Reporting Inaccuracies

  • Aviation Professionals should promptly report incorrect profile information, unauthorised access to their documents, suspected impersonation, and other material misuse.
  • Aerocruitment may investigate and take appropriate action in accordance with these Terms and Applicable Law.

SECTION 6 — EMPLOYER AND RECRUITER RESPONSIBILITIES

6.1 Legitimate Recruitment Activity

  • Employers and Recruiters must use the Platform only for legitimate recruitment, candidate assessment, workforce planning, and related employment purposes.
  • They must possess the authority necessary to advertise vacancies or conduct recruitment on behalf of the relevant organisation.

6.2 Accurate Vacancies

Employers and Recruiters must ensure that vacancy listings and recruitment communications are accurate and not materially misleading.

Where reasonably applicable, listings should identify:

  • The hiring organisation or authorised recruiting party.
  • The position and principal duties.
  • Required qualifications and experience.
  • The applicable licence, rating, and medical requirements.
  • The anticipated employment arrangement.
  • Material remuneration and working-condition information.
  • Location and rotation arrangements.
  • Relevant work-authorisation requirements.

Aerocruitment may establish mandatory vacancy fields and verification requirements.

6.3 Recruitment Authority

  • Recruiters must have appropriate authority to represent the Employer concerned.
  • Recruiters must not claim to represent an airline, operator, aircraft owner, or other organisation without the necessary authorisation.

6.4 Independent Candidate Verification

Employers remain responsible for independently verifying candidate qualifications before making hiring decisions or assigning individuals to operational duties.

Where relevant, this includes verifying:

  • Licence validity and applicable privileges.
  • Type ratings and other qualifications.
  • Instrument ratings.
  • Medical certificate validity.
  • Flight hours and experience.
  • Training and examination records.
  • Right to work and employment authorisation.
  • Background checks and security clearances where legally required.
  • Any other applicable regulatory, operational, or employment requirements.

Employers must not rely solely on a profile, uploaded document, verification badge, or automated Platform result when independent verification is required.

6.5 Lawful Recruitment

  • Employers and Recruiters must comply with applicable employment, privacy, anti-discrimination, immigration, aviation, and consumer protection laws.
  • They must not use the Platform to facilitate unlawful discrimination, deceptive recruitment, trafficking, exploitation, fraudulent payments, or other prohibited activity.

6.6 Candidate Information

Employers and Recruiters must handle Candidate Documentation and personal information in accordance with Section 8, the Privacy Policy, and Applicable Law.

6.7 Recruitment Fees

  • Employers and Recruiters must not misrepresent fees, charges, or other financial obligations associated with a vacancy.
  • Any recruitment or placement fee charged to a candidate must comply with Applicable Law and must not be presented as an Aerocruitment charge unless it is genuinely charged by Aerocruitment.

6.8 Employer Responsibility

  • Employers remain responsible for their hiring decisions, employment agreements, candidate assessments, and compliance with applicable employment and aviation requirements.
  • Nothing in these Terms excuses an Employer from a legal duty that applies to it.

SECTION 7 — CREDENTIAL VERIFICATION AND VERIFIED BADGES

7.1 Optional Verification Services

  • Aerocruitment may provide or facilitate verification features, including checks against third-party databases, regulatory records, submitted documentation, or other available sources.
  • The availability and scope of verification services may vary by jurisdiction, data source, and Platform feature.

7.2 Best-Efforts Verification

  • Unless expressly stated otherwise in a separate written agreement, verification is performed on a best-efforts basis.
  • Verification may depend on the availability, completeness, accuracy, and currency of information provided by third parties.

7.3 No Regulatory Certification

A verification badge does not constitute:

  • An aviation authority's endorsement.
  • A guarantee of a pilot's current licence privileges.
  • Confirmation of current medical fitness.
  • Certification of competence or operational performance.
  • Confirmation that a candidate is suitable for a particular position.
  • A guarantee that all documents are genuine or current.

7.4 Time-Specific Results

  • Verification results reflect the information available at the time of the relevant check.
  • Qualifications or records may subsequently expire, be suspended, be revoked, or otherwise change.
  • Where reasonably practicable, Aerocruitment may display the verification date, verification scope, or limitations associated with a result.

7.5 Employer Responsibility

  • Employers must independently confirm the qualifications and authorisations required for their hiring and operational decisions.
  • The existence of a verification badge does not remove an Employer's independent responsibilities.

7.6 Disputed Results

  • Users may notify Aerocruitment if they believe a verification result is inaccurate.
  • Aerocruitment may review the information, request supporting evidence, amend the result, or suspend a badge while investigating.

7.7 Suspected Fraud

Aerocruitment may restrict or remove verification indicators and take appropriate account action where there is reasonable concern about falsified documentation, misleading information, or misuse of the verification system.

7.8 No Absolute Accuracy Guarantee

  • To the extent permitted by Applicable Law, Aerocruitment disclaims warranties regarding the completeness, accuracy, and continued currency of third-party verification data.
  • Nothing in this section excludes liability that cannot lawfully be excluded.

SECTION 8 — CANDIDATE DOCUMENTATION, DOWNLOADS, AND EXTERNAL USE

8.1 Uploading Documentation

Aviation Professionals may upload Candidate Documentation to support their profiles and applications. Users must have the right and lawful basis to submit it, including any information about other people.

Uploading authorises hosting and processing necessary to provide the requested service, subject to the Privacy Policy and Applicable Law. It does not transfer ownership, make the document public, or automatically authorise access by every Employer or Recruiter. Users should omit or redact information unnecessary for the intended recruitment purpose.

8.2 Authorised Access

Aerocruitment may make Candidate Documentation available only in accordance with the documents, recipients or clearly described recipient categories, and purposes disclosed to the Aviation Professional through the relevant application, sharing action or access setting.

Before enabling access, Aerocruitment will explain what will be shared, who may receive it, whether downloading is permitted, and the intended use. Any consent or other condition required by Applicable Law must be satisfied before disclosure.

Technical availability of a document or payment for an Unlock does not by itself authorise access to every uploaded document. Access granted in error must not be exploited and must be reported promptly to privacy@aerocruitment.com.

8.3 Downloads and External Storage

An authorised Employer or Recruiter may download documents expressly made available for downloading under Section 8.2 and securely store them in its recruitment systems solely for the disclosed recruitment process. Permitted use includes assessing suitability, arranging interviews, lawfully verifying credentials and maintaining necessary records of that process.

Access must be limited to information reasonably necessary for that purpose. Background checks, sensitive-information processing and international transfers require any additional legal basis, conditions, notices and safeguards applicable to them. These contractual permissions do not replace those requirements.

A recipient must not treat possession of a downloaded copy as permission for unrelated use, unrestricted circulation or indefinite retention.

8.4 Onward Sharing

An Employer or Recruiter must obtain the Aviation Professional's prior, specific authorisation before submitting Candidate Documentation to a different prospective employer or recruitment client. That authorisation must identify the organisation and purpose; an application directly to an identified Employer authorises submission to that Employer within the disclosed application process.

Within an authorised process, recipients may share only necessary information with their authorised recruitment personnel, legal or compliance advisers and contracted screening or verification providers who need it for that process. Such recipients must be subject to appropriate confidentiality, security and data-protection obligations. Service providers must not use the information for their own unrelated purposes.

Disclosure to authorities is permitted where legally required or otherwise specifically authorised and lawful. Any further disclosure remains subject to Applicable Law, including international-transfer requirements. Recruiters must retain evidence of candidate authorisation and provide it to Aerocruitment on reasonable request where lawful.

8.5 Restrictions on Document Use

Employers and Recruiters must not:

  • Sell Candidate Documentation or personal information obtained through the Platform.
  • Publish private documents publicly without appropriate authorisation.
  • Use documents for unrelated marketing, advertising, or commercial purposes.
  • Use documentation to impersonate a candidate or commit fraud.
  • Alter documents in a misleading manner.
  • Distribute documents indiscriminately.
  • Access documents through unauthorised means.
  • Retain or use documents contrary to Applicable Law.
  • Use downloaded documentation to create misleading profiles or unauthorised databases.
  • Share medical or other sensitive information with persons who have no legitimate need or legal authority to receive it.

These restrictions do not prevent disclosure or retention required by law. Any other processing remains subject to the specific permissions and safeguards in this Section 8.

8.6 Recipient Responsibility and Security Incidents

Employers and Recruiters must protect downloaded copies using appropriate technical and organisational safeguards, restrict access, maintain lawful processing and retention practices, and respond to requests concerning information they control. Where they determine their own processing purposes and means, they act as independent responsible parties or controllers; the actual arrangement and Applicable Law determine their role.

Recipients must notify privacy@aerocruitment.com without undue delay after becoming aware of suspected unauthorised access, loss or disclosure involving Platform-sourced candidate information, provide available relevant details securely, and cooperate in containment and remediation. This does not replace their own obligations to notify individuals or regulators.

Aerocruitment does not control external copies but remains responsible for its own collection, disclosure, security and processing obligations.

8.7 Retention and Deletion

Recipients must establish and communicate a retention period or criteria appropriate to the disclosed purpose. They must review necessity when recruitment ends or the candidate withdraws, and securely delete or irreversibly anonymise information when retention is no longer justified.

Limited retention for a legal obligation or the establishment, exercise or defence of legal claims must have a lawful basis, be restricted to that purpose, and remain subject to periodic review. Successful recruitment does not authorise unrestricted transfer of all documents into an employment record; only necessary information may be retained for disclosed, lawful employment purposes.

Retention for future opportunities requires a separately disclosed purpose and lawful basis, including specific consent where required. An unspecified possibility of future recruitment does not justify indefinite retention. Recipients must apply lawful deletion and access restrictions to backup copies as well as active systems.

8.8 Removal, Restrictions and Candidate Requests

Aviation Professionals may use available controls or contact privacy@aerocruitment.com to request correction, removal, restriction or information about recipients. Aerocruitment and recipients must handle requests within applicable legal deadlines.

Removal or account closure does not automatically retrieve externally downloaded copies. Aerocruitment will communicate corrections, erasure or restrictions to recipients where required by law and otherwise take reasonable steps where appropriate and lawful. Recipients must assess and implement the resulting obligations for copies they hold.

Where processing relies on consent, consent may be withdrawn at any time without affecting lawful processing before withdrawal. Future processing based on that consent must stop; any lawful continued retention must be explained and restricted to its valid basis. Revoking access prevents future access within the scope of the revocation, subject to legal obligations.

8.9 Sensitive Documentation

Medical certificates and health information require the additional processing conditions applicable to them. Identity and financial documents also require safeguards appropriate to their risks, although legal classifications vary by jurisdiction.

Aerocruitment and recipients must establish the necessary lawful basis and any additional sensitive-data condition before access, use or disclosure, obtain specific consent where required, and limit access to people who need the information for the authorised purpose. General acceptance of these Terms or uploading a document is not blanket consent.

Where sufficient, a recipient must use relevant qualification or certificate-status information instead of collecting unnecessary underlying medical details.

8.10 No Transfer of Ownership

  • The permissions granted under this section concern access and permitted use only.
  • They do not transfer ownership of Candidate Documentation to Aerocruitment, Employers, or Recruiters.
  • Any copyright or other intellectual property rights remain with their respective owners, subject to the licences expressly granted under these Terms.

SECTION 9 — USER CONDUCT AND PROHIBITED ACTIVITIES

Users must not use the Platform to:

9.1 Fraud and Misrepresentation

  • Submit false or misleading information.
  • Forge or misleadingly alter professional documentation; lawful redactions under Section 5.2 are permitted.
  • Impersonate an individual, Employer, Recruiter, or regulatory authority.
  • Advertise fictitious vacancies.
  • Misrepresent recruitment authority or employment opportunities.

9.2 Unauthorised Data Collection

  • Scrape or systematically extract Platform data.
  • Use automated tools to collect information without authorisation.
  • Build or populate competing databases using unauthorised access to Platform information.
  • Circumvent technical restrictions on document or contact access.

9.3 Unauthorised Commercial Activity

  • Evade applicable Platform fees through duplicate accounts or manipulated transactions.
  • Sell Candidate Documentation or redistribute it outside Section 8, regardless of how it was obtained.
  • Use contact information for unsolicited marketing unrelated to legitimate recruitment.
  • Manipulate unlock records or earnings transactions.

9.4 Security Violations

  • Introduce malware or harmful code.
  • Attempt to compromise Platform security.
  • Access another User's account without authority.
  • Interfere with the operation of the Platform.
  • Reverse-engineer or exploit the Platform except where expressly permitted by law.

9.5 Abuse and Harassment

  • Harass, threaten, intimidate, or unlawfully discriminate against other Users.
  • Use the Platform for stalking, identity theft, or other unlawful activity.
  • Misuse confidential or sensitive information.

9.6 Intellectual Property Violations

Users must not upload, distribute, or use content in a manner that infringes another person's intellectual property, confidentiality, privacy, or other legal rights.

9.7 General Enforcement

  • Aerocruitment may investigate suspected violations and take reasonable measures, including content removal, access restrictions, account suspension, termination, and reporting where appropriate.
  • Actions will be subject to Applicable Law and any applicable notice or procedural requirements.

SECTION 10 — FRAUD PREVENTION AND EMPLOYER AUTHENTICITY

10.1 Verification of Employers

  • Aerocruitment may request information reasonably necessary to assess an Employer's identity, legitimacy, authority, or recruitment activities.
  • Verification may include business information, corporate contact details, domain information, authorisation documents, or other supporting evidence.

10.2 No Guarantee of Employer Legitimacy

  • Unless expressly stated otherwise, an Employer's registration or verification does not constitute an unconditional guarantee of its legitimacy, financial stability, conduct, or suitability.
  • Users should independently assess unfamiliar organisations and employment offers.

10.3 Fraudulent Vacancies

Aerocruitment may remove or restrict access to vacancies that it reasonably suspects are fraudulent, unauthorised, materially misleading, unlawful, or otherwise contrary to these Terms.

10.4 Reporting Suspicious Activity

Users may report suspicious Employers, Recruiters, vacancies, documents, communications, or payment requests using the reporting facilities made available by Aerocruitment.

10.5 Investigations

Aerocruitment may request additional information, restrict accounts, preserve relevant records, and cooperate with competent authorities where appropriate and legally permitted.

10.6 No Guarantee of Detection

  • Aerocruitment does not guarantee that every fraudulent account, document, vacancy, or communication will be detected before causing harm.
  • Users remain responsible for exercising reasonable caution and verifying information relevant to their decisions.
  • This provision does not excuse Aerocruitment from legal obligations that apply to its own conduct.

SECTION 11 — NO-CIRCUMVENTION AND PLATFORM INTEGRITY

11.1 Legitimate Direct Communication

  • Aerocruitment recognises that Employers and Aviation Professionals may communicate directly and may enter into employment relationships outside the Platform.
  • Such direct communication is not, by itself, a breach of these Terms.

11.2 Fee Evasion

Users must not deliberately manipulate Platform functionality or account arrangements to evade applicable fees or payment obligations.

Prohibited conduct includes:

  • Creating duplicate accounts to obtain repeated free access.
  • Circumventing paid contact-unlock requirements.
  • Manipulating transactions to obtain credits or refunds improperly.
  • Using unauthorised access to retrieve restricted contact information.
  • Knowingly exploiting technical vulnerabilities to avoid agreed charges.

11.3 Unauthorised Extraction

Users must not systematically extract or reproduce Candidate Documentation, contact details, or other restricted Platform data for unauthorised commercial use.

11.4 Enforcement

  • Aerocruitment may suspend access, reverse fraudulent credits, recover unpaid contractual fees where legally permitted, and pursue other lawful remedies for proven violations.
  • Nothing in this section imposes an unlawful restriction on a person's ability to seek employment or on an Employer's lawful recruitment activities.

SECTION 12 — SUBSCRIPTIONS, FEES, BILLING, AND REFUNDS

12.1 Paid Features

Certain Platform features may require payment.

These may include:

  • Premium professional profiles.
  • Employer access subscriptions.
  • Candidate contact unlocks.
  • Enhanced recruitment tools.
  • Other paid features identified in the applicable pricing schedule.

12.2 Pricing

  • Fees will be displayed before the relevant purchase is completed.
  • Unless otherwise stated, prices are quoted in United States dollars and exclude applicable taxes.
  • The total payable to Aerocruitment, including applicable taxes and known mandatory charges, will be disclosed before purchase.

12.3 Authorisation of Payments

  • By purchasing a paid feature, you authorise the relevant payment provider to process the transaction using the payment method you select.
  • Users must provide accurate billing information and maintain appropriate payment authorisation.

12.4 Automatic Renewal

  • Where a subscription automatically renews, the renewal frequency, applicable price, and cancellation method will be disclosed before purchase.
  • Subscriptions will renew unless cancelled before the applicable renewal date, subject to Applicable Law.
  • Where required, Aerocruitment will provide renewal notices, obtain express consent, or provide a legally compliant cancellation mechanism.

12.5 Cancellation

Users may cancel renewal through available subscription controls or by emailing legal@aerocruitment.com from their registered email address. A request received before the renewal time stops that renewal; processing delays by Aerocruitment will not invalidate a timely request. Aerocruitment will confirm cancellation.

Unless a User requests immediate account closure or Applicable Law requires otherwise, paid access continues until the end of the paid billing period. Cancellation does not by itself create a refund for that period, subject to Section 12.7. Account closure also cancels future renewals.

12.6 Price Changes

Price changes apply prospectively. Aerocruitment will give at least 30 days' advance notice of increases affecting an existing Subscription, or longer where required by law. The increase will take effect no earlier than the first renewal after that notice period. Users may cancel before the affected renewal. Any further consent required by law will be obtained.

12.7 Refunds and Service Remedies

Fees purchase the disclosed Platform features, not a guaranteed interview, job offer, response or hire. Lack of a recruitment outcome alone does not create a refund entitlement.

Users may report duplicate charges, billing errors, unauthorised payments or a failure to deliver a paid feature to legal@aerocruitment.com. Aerocruitment will investigate and correct confirmed billing errors. For a material failure to supply a paid service, Aerocruitment will provide an appropriate remedy, including restoration, repeat performance, price reduction or refund as required by Applicable Law. Where restoration within a reasonable time is not possible, the affected unprovided portion will be refunded.

Refunds will be made to the original payment method where practicable, within applicable legal deadlines. Statutory cancellation, cooling-off, refund and payment-dispute rights remain unaffected. Any required express request to begin service during a cooling-off period, or acknowledgement concerning loss of a withdrawal right, must be obtained separately where applicable.

12.8 Contact Unlock Fees

  • Where an Employer pays to unlock a candidate's contact information, the applicable fee is charged when the unlock transaction is completed, as disclosed before purchase.
  • Unless required otherwise by law or expressly stated in the applicable pricing terms, an unlock fee is not refundable merely because the candidate does not respond or the recruitment process does not result in employment.
  • Aerocruitment may reverse or refund a transaction where appropriate, including in cases of verified technical errors or fraudulent activity.

12.9 Failed Payments

  • Where a payment fails, Aerocruitment may restrict access to paid features until the payment issue is resolved.
  • Users remain responsible for properly authorised charges incurred under their subscriptions.

12.10 Taxes and Currency Conversion

  • Users are responsible for taxes applicable to their purchases where legally required.
  • Payment providers or financial institutions may apply currency conversion charges or transaction fees. Aerocruitment will disclose known applicable charges before purchase where required by law.

12.11 Payment Disputes

  • Users should promptly notify Aerocruitment of suspected billing errors or unauthorised charges.
  • Nothing in this section limits statutory payment dispute rights or rights under applicable payment-provider rules.

SECTION 13 — CREW EARNINGS AND EARN-PER-UNLOCK PROGRAMME

13.1 Programme Overview

Eligible Aviation Professionals with genuine accounts may earn credits from qualifying paid Unlocks under this Section. Participation is subject to account eligibility and payout restrictions required by Applicable Law. This Section supplies the programme rules; additional conditions must be disclosed before the activity they govern and cannot retrospectively remove valid accrued Earnings.

13.2 Standard Earning Rate

  • Unless otherwise stated in the applicable programme terms, the standard earning rate is US$1.00 per unique company-to-crew unlock.
  • Aerocruitment may change the rate prospectively by providing appropriate notice and updating the applicable programme terms.

13.3 Qualifying Unique Unlocks

Only the first completed, genuine paid Unlock by a distinct company legal entity of a particular Crew Member qualifies. Free, test, failed, duplicate, self-funded or collusive Unlocks do not qualify. Multiple users or accounts acting for the same company count as one company. Repeat Unlocks do not generate further Earnings.

Account consolidation or a company merger does not create a new qualifying Unlock or retrospectively cancel genuine Earnings. Demonstrable duplicate credits and credits attributable to fraud, failed payment or a refunded or reversed underlying transaction may be corrected with an explanation. Genuine unrelated Earnings remain unaffected.

13.4 No Guaranteed Earnings

  • Participation does not guarantee any minimum or maximum level of earnings.
  • Earnings depend on eligible unlock activity and the applicable programme rules.

13.5 Earnings Status

Earnings are pending until the underlying payment and eligibility have been validated, then verified. Verified Earnings are available for withdrawal once the threshold is reached, subject to lawful payout checks. A paid balance is one for which payment has been issued. Aerocruitment will make these statuses available in the account or on request and provide reasons for a hold or correction, except where disclosure is prohibited by law or would compromise a legitimate investigation.

Earnings are contractual programme credits, not a bank deposit, transferable payment account or interest-bearing balance.

13.6 Minimum Payout Threshold and Account Closure

The ordinary minimum withdrawal threshold is US$200 in verified Earnings. On permanent account closure or programme discontinuation, a Crew Member may request payment of all verified outstanding Earnings regardless of that threshold, subject to lawful identity and payment checks. Aerocruitment will explain available payment methods and request missing details.

Failure to provide valid payment details may delay payment but does not itself forfeit valid Earnings. Any legally required treatment of unclaimed funds remains applicable. No payment may be deducted twice or withheld solely because the account is closed.

13.7 Payout Methods

Available methods may include:

  • PayPal.
  • Bank transfer.
  • Conversion to eligible in-app credit.

The availability of particular methods may vary by country, payment provider, account status, and legal requirements.

13.8 Payout Processing

Aerocruitment will issue payment within 30 business days after receiving a valid request and the information reasonably required to pay lawfully, or sooner where law requires. Business days exclude weekends and public holidays where the paying entity is registered.

If a lawful hold prevents payment, Aerocruitment will explain the reason and required next steps where legally permitted, review the hold regularly, and issue payment promptly once resolved. Payment-provider settlement times may affect receipt. Any known payout or conversion charges will be disclosed before the User selects a method; undisclosed Aerocruitment charges will not be deducted.

13.9 Accurate Payment Details

  • Crew Members must provide accurate and current payout information.
  • Aerocruitment is not responsible for delays or losses caused by incorrect details supplied by a User, except to the extent attributable to Aerocruitment's own breach of an applicable legal obligation.

13.10 Taxes

  • Crew Members are responsible for determining and fulfilling their tax obligations in their relevant jurisdictions.
  • Aerocruitment does not provide individual tax advice.
  • Any statement that earnings are not wages or salary reflects the intended structure of the programme and does not override the legal character assigned to a payment by Applicable Law.

13.11 Programme Changes and Discontinuation

Aerocruitment may change or discontinue the programme with at least 30 days' advance notice, except where shorter notice is required by law or necessary to address urgent fraud or security risks. Rate changes apply only to future qualifying Unlocks after the stated effective date.

Verified Earnings and valid pending payout requests remain payable. Pending Earnings will be assessed under the rules applicable when generated. On discontinuation, the ordinary payout threshold is waived under Section 13.6. Conversion to in-app credit requires the Crew Member's choice and cannot be imposed instead of payment.

13.12 Holds, Corrections and Disputes

Aerocruitment may temporarily hold disputed Earnings on reasonable evidence of fraud, duplication or ineligibility. It will provide the reasons and an opportunity to respond before a final reversal, except where law prohibits disclosure or immediate action is necessary. Only amounts reasonably attributable to the relevant issue may be reversed; unrelated valid Earnings are not forfeited for an account breach.

Users may dispute a correction by contacting legal@aerocruitment.com. Aerocruitment will consider relevant evidence, communicate its decision and release any unjustified hold without undue delay. Statutory remedies remain available.

13.13 Inactivity

After 24 months of inactivity, Aerocruitment may send an account review notice. Inactivity alone does not forfeit verified Earnings. If an inactive account is closed, Section 13.6 applies, together with any mandatory unclaimed-funds requirements.

13.14 No Employment Relationship Created

  • Participation in the earnings programme does not, by itself, establish an employment relationship with Aerocruitment.
  • The legal classification of the arrangement will nevertheless depend on its actual operation and Applicable Law.

SECTION 14 — INTELLECTUAL PROPERTY AND USER CONTENT

14.1 Company Intellectual Property

  • The Platform's software, design, branding, trademarks, interface, algorithms, databases, and other Company-owned materials are protected by applicable intellectual property laws.
  • Except as expressly permitted, Users acquire no ownership rights in these materials.

14.2 User Ownership

  • Users retain ownership of content and documentation they own, subject to the rights of other persons and any licences expressly granted under these Terms.
  • Uploading content does not automatically transfer ownership to Aerocruitment.

14.3 Licence to Operate the Platform

By submitting content to the Platform, Users grant Aerocruitment a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, and distribute that content to the extent reasonably necessary to:

  • Operate the Platform.
  • Display professional profiles and vacancies according to User settings.
  • Facilitate recruitment and communication.
  • Provide authorised document access.
  • Maintain security and prevent fraud.
  • Improve Platform functionality.
  • Comply with legal obligations.

This licence includes the right to use service providers and subprocessors where reasonably necessary, subject to applicable contractual and legal safeguards.

The licence grants no public-marketing rights beyond Section 14.4 and does not authorise unrelated AI-model training using private Candidate Documentation.

The licence ends when content is removed or the account closes, except to the limited extent needed for lawful retention, restricted backup cycles, legal claims or completion of previously authorised disclosures. Retained copies may not be reused for unrelated purposes. Section 8 continues to govern lawfully downloaded copies.

14.4 Public Promotion

Aerocruitment will not use private Candidate Documentation, medical information, identity documents or financial information in public advertising or promotional materials. Use of a candidate's name, photograph, identifiable profile or testimonial for public promotion requires separate, specific permission describing the intended use.

Making a profile visible for recruitment does not by itself grant promotional permission. Withdrawal of consent will be respected where processing relies on consent. This clause does not prevent ordinary display of an authorised profile or vacancy within the recruitment service.

14.5 User Warranties

  • Users warrant that they own or have the necessary permissions to submit the content and grant the licences described in these Terms.
  • Users must not upload content that infringes another person's rights.

14.6 Removal of Content

  • Aerocruitment may remove or restrict content that violates these Terms, infringes third-party rights, creates material security or legal risks, or must be removed under Applicable Law.
  • Where appropriate, Users may be notified and given an opportunity to correct the issue.

SECTION 15 — PRIVACY AND DATA PROTECTION

15.1 Privacy Policy

  • Aerocruitment's Privacy Policy explains how personal information is collected, used, stored, disclosed, and otherwise processed.
  • The Privacy Policy is available at https://aerocruitment.com/Privacy. Aerocruitment will keep it consistent with actual processing practices and notify Users of material changes.

15.2 Applicable Laws

  • Aerocruitment and Users must comply with the data protection and privacy laws applicable to their activities.
  • Depending on the circumstances, these may include South Africa's Protection of Personal Information Act (POPIA), the EU General Data Protection Regulation (GDPR), the UK GDPR, the California Consumer Privacy Act as amended, and other applicable laws.
  • The applicability of a particular law depends on the relevant jurisdiction, activities, and legal criteria.

15.3 Purposes of Processing

Personal information may be processed for legitimate and disclosed purposes, including:

  • Account creation and administration.
  • Professional profile management.
  • Recruitment and candidate discovery.
  • Employer and candidate communications.
  • Document storage and authorised disclosure.
  • Credential verification.
  • Payment processing.
  • Earnings administration.
  • Fraud prevention and security.
  • Customer support.
  • Legal and regulatory compliance.
  • Service improvement and analytics, where lawful.

15.4 Sensitive Information

  • Information concerning medical certificates, health status, identity, or other sensitive matters may be subject to additional restrictions.
  • Aerocruitment will establish the appropriate lawful basis and any additional sensitive-data processing condition before processing, and obtain specific consent where required.

15.5 Data Sharing

  • Personal information may be disclosed to authorised Employers, Recruiters, service providers, payment processors, verification providers, and other recipients as described in the Privacy Policy and permitted by Applicable Law.
  • Candidate disclosures remain subject to Section 8 and the notices and permissions associated with the relevant feature.

15.6 International Transfers

Where personal information is transferred internationally, Aerocruitment will implement applicable safeguards and comply with relevant transfer requirements.

15.7 Security

  • Aerocruitment will implement appropriate technical and organisational measures designed to protect personal information against unauthorised access, disclosure, alteration, loss, and destruction.
  • No electronic system can be guaranteed to be completely secure.

15.8 Data Breaches

Aerocruitment will assess suspected personal-data breaches and provide notices to affected individuals, regulators, or other parties where required by Applicable Law.

15.9 User Rights

  • Subject to Applicable Law, individuals may have rights to access, correct, delete, restrict, or object to certain processing of their personal information.
  • Requests may be submitted using the contact details provided in the Privacy Policy.

15.10 Data Retention

Aerocruitment will retain personal information only for as long as reasonably necessary for disclosed purposes, subject to legal, regulatory, security, accounting, and dispute-resolution requirements.

15.11 Employer Obligations

  • Employers and Recruiters accessing personal information through the Platform must independently comply with their applicable privacy obligations.
  • They must use information only for authorised purposes, protect it appropriately, and respond to relevant legal requests concerning information they control.

15.12 No Waiver of Privacy Rights

Nothing in these Terms constitutes a blanket waiver of an individual's statutory privacy rights or removes legal obligations applicable to Aerocruitment or another User.

SECTION 16 — THIRD-PARTY SERVICES AND INTEGRATIONS

16.1 Third-Party Services

The Platform may integrate with external services, including payment processors, hosting providers, analytics tools, verification providers, and regulatory databases.

16.2 External Terms

  • Third-Party Services may be subject to their own terms, privacy policies, and operating conditions.
  • Users are responsible for reviewing applicable third-party terms when using those services.

16.3 External Data

  • Information obtained through third-party databases may be incomplete, delayed, unavailable, or inaccurate.
  • Aerocruitment does not control the operation of independent external databases.

16.4 No Blanket Endorsement

The presence of a link, integration, or third-party service does not necessarily constitute an endorsement by Aerocruitment.

16.5 Payment and Verification Providers

  • Aerocruitment may depend on external providers to process payments or retrieve verification information.
  • The Company will address its own contractual and legal responsibilities for those integrations in accordance with Applicable Law.

SECTION 17 — PLATFORM AVAILABILITY AND TECHNICAL LIMITATIONS

17.1 Availability

Aerocruitment will make reasonable efforts to maintain the Platform but does not guarantee uninterrupted availability.

17.2 Maintenance and Changes

  • The Company may perform maintenance, update software, modify features, or discontinue functionality.
  • Where practicable, material interruptions will be communicated in advance. If a material paid feature is withdrawn or substantially reduced during a prepaid period, the affected User may cancel that service and receive a proportionate refund for the unprovided portion, without limiting any greater statutory remedy.

17.3 Technical Failures

Temporary interruptions may arise from hosting failures, connectivity problems, third-party outages, cyber incidents, maintenance, or other technical circumstances.

17.4 Data Protection and Backups

  • Aerocruitment will maintain appropriate security and backup arrangements in accordance with its operational needs and applicable legal obligations.
  • Users should retain their own copies of documents where appropriate and lawful.

17.5 No Guarantee of Error-Free Operation

  • To the extent permitted by Applicable Law, Aerocruitment does not warrant that the Platform will always be free from defects, errors, interruptions, or vulnerabilities.
  • This disclaimer does not exclude liability for obligations that cannot lawfully be excluded.

SECTION 18 — DISCLAIMERS AND LIMITATION OF WARRANTIES

18.1 Platform Availability

To the fullest extent permitted by Applicable Law, the Platform and its general features are provided on an "as is" and "as available" basis.

18.2 Disclaimed Warranties

To the extent legally permissible, Aerocruitment disclaims implied warranties that the Platform will be suitable for every User's particular needs, continuously available, error-free, or capable of producing a specific employment or commercial result.

18.3 Third-Party Information

Aerocruitment does not guarantee the completeness, accuracy, or continued currency of information supplied by independent Users or third parties.

18.4 Independent User Decisions

Users are responsible for independently evaluating candidates, Employers, vacancies, employment contracts, and other opportunities.

18.5 Non-Excludable Rights

Nothing in this section excludes a warranty, duty, or liability that cannot lawfully be excluded or limited.

SECTION 19 — LIMITATION OF LIABILITY

19.1 Exclusion of Certain Losses

  • To the fullest extent permitted by Applicable Law, Aerocruitment will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the use of the Platform.
  • Where legally permissible, this exclusion may include loss of anticipated profits, business opportunities, goodwill, or revenue.

19.2 Recruitment Outcomes

Subject to Applicable Law, Aerocruitment is not responsible for losses arising solely from independent hiring decisions, employment negotiations, or contractual arrangements between Users.

19.3 Aviation Activities

  • Aerocruitment does not operate aircraft or exercise operational control over aircraft through its ordinary Platform services.
  • To the fullest extent permitted by law, the Company excludes liability for losses arising solely from independent aviation operations or employment decisions outside its control.
  • Nothing in these Terms excludes liability for Aerocruitment's own acts or omissions where such liability cannot lawfully be excluded.

19.4 Candidate and Employer Conduct

Subject to Applicable Law, Aerocruitment is not responsible for a User's independent misconduct, misrepresentation, contractual breach, or failure to perform obligations to another User.

19.5 Aggregate Liability Cap

To the fullest extent permitted by Applicable Law, Aerocruitment's aggregate liability to a User for claims arising from or relating to the Platform will not exceed the greater of:

  • (a) The total amount paid by that User to Aerocruitment during the 12 months immediately preceding the event giving rise to the claim; or
  • (b) US$100.

This limitation applies only to the extent legally enforceable and does not override any mandatory statutory rights or liabilities that cannot lawfully be limited.

19.6 Exceptions

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited under Applicable Law.

19.7 Allocation of Risk

  • The parties acknowledge that these limitations are intended to allocate commercial risks associated with an online recruitment marketplace.
  • The enforceability and scope of each limitation remain subject to Applicable Law.

SECTION 20 — INDEMNIFICATION

20.1 User Indemnity

To the extent permitted by Applicable Law, each User agrees to indemnify Aerocruitment against third-party claims, losses, liabilities, and reasonable legal expenses arising directly from:

  • The User's material breach of these Terms.
  • Fraudulent or materially misleading information submitted by the User.
  • The User's unlawful conduct.
  • The User's infringement of third-party rights.
  • The User's unauthorised disclosure or misuse of personal information.
  • The User's violation of applicable law.
  • The User's unauthorised use of Candidate Documentation.
  • The User's fraudulent manipulation of Platform transactions.

20.2 Employer-Specific Indemnity

To the extent permitted by Applicable Law, Employers and Recruiters additionally agree to indemnify Aerocruitment against third-party claims arising directly from their unlawful recruitment practices, unauthorised use of candidate information, or failure to comply with legal obligations applicable to their recruitment activities.

20.3 Causation and Responsibility

An indemnity applies only to the extent that the relevant claim or loss falls within its scope and is attributable to the indemnifying party's conduct or other specified circumstances.

No indemnity applies to the extent a loss is caused by Aerocruitment's own negligence, breach of these Terms, unlawful conduct or fraud, or to liability that cannot lawfully be transferred. There will be no double recovery under overlapping indemnities.

20.4 Claims Procedure

Aerocruitment will promptly notify the indemnifying User of a claim and take reasonable steps to mitigate loss. A delay in notice reduces the indemnity only to the extent it materially prejudices the defence.

The User may assume the defence with suitably qualified counsel reasonably acceptable to Aerocruitment. Aerocruitment may participate at its own expense, except for reasonable separate representation required by a material conflict of interest. If the User does not assume the defence within a reasonable time after notice, Aerocruitment may defend the claim and recover reasonable costs within the indemnity's scope.

Neither party may settle a claim in a way that binds the other, admits wrongdoing on its behalf or imposes an obligation on it without its prior written consent, which must not be unreasonably withheld. The parties will cooperate reasonably, subject to privilege, confidentiality and Applicable Law.

SECTION 21 — ACCOUNT SUSPENSION, TERMINATION, AND DELETION

21.1 Suspension

Aerocruitment may suspend or restrict access where reasonably necessary to:

  • Investigate suspected fraud.
  • Protect Users or the Platform.
  • Address a security incident.
  • Enforce payment obligations.
  • Investigate a material breach of these Terms.
  • Comply with legal or regulatory requirements.

Where appropriate, the User will be notified and given an opportunity to respond. Immediate action may be taken where reasonably necessary to address urgent security, fraud, safety, or legal risks.

21.2 Termination by Aerocruitment

Aerocruitment may terminate an account for material breaches, fraudulent activity, unlawful conduct, persistent non-payment, or other legitimate reasons, subject to Applicable Law and any applicable notice requirements.

21.3 Termination by Users

Users may request account closure using the available account controls or by contacting Aerocruitment.

21.4 Effects of Termination

Upon termination:

  • Access to the account may be disabled.
  • Public profile visibility may be removed or restricted.
  • Paid features may cease according to the applicable subscription terms.
  • Unpaid fees lawfully due may remain payable.
  • Earnings will be handled in accordance with Section 13.
  • Personal information will be retained or deleted in accordance with the Privacy Policy and Applicable Law.

21.5 Downloaded Documents

  • Termination of an Aviation Professional's account does not automatically retrieve documents previously downloaded by Employers or Recruiters.
  • Receiving parties remain responsible for handling those documents lawfully.
  • Aerocruitment will communicate applicable restrictions and deletion requests as required by Section 8.8 and Applicable Law.

21.6 Retention of Records

Aerocruitment may retain records where reasonably necessary for legal compliance, fraud prevention, accounting, security, dispute resolution, or the establishment or defence of legal claims.

21.7 Survival

Provisions that by their nature should survive termination will remain in effect, including applicable provisions concerning intellectual property, privacy, liability, indemnification, payments, dispute resolution, and obligations relating to previously downloaded documentation.

SECTION 22 — GOVERNING LAW AND DISPUTE RESOLUTION

22.1 Governing Law

  • These Terms will be governed by the laws of the Republic of South Africa, subject to mandatory legal provisions applicable to the relevant User or transaction.
  • The choice of governing law does not remove any mandatory rights or protections that Applicable Law requires to remain available.

22.2 Good-Faith Resolution

  • Before commencing formal proceedings, the parties should attempt to resolve disputes through good-faith communication where reasonably practicable.
  • This requirement does not prevent a party from seeking urgent relief, complying with a legal deadline, or exercising a statutory right.

22.3 Optional Arbitration

These Terms do not impose mandatory arbitration. After a dispute arises, the parties may separately agree in writing to arbitration, specifying the institution or arbitrator, rules, seat, language and allocation of costs. Without such an agreement, Section 22.6 applies.

22.4 Claims and Statutory Remedies

These Terms do not impose a class-action or representative-proceedings waiver. Each party retains the procedural and statutory rights available under Applicable Law.

22.5 Urgent Relief

Either party may seek urgent injunctive or other appropriate relief from a competent court where necessary to protect legal rights or prevent irreparable harm, subject to Applicable Law.

22.6 Court Proceedings

Where a dispute is not subject to a valid arbitration agreement, it may be brought before a court of competent jurisdiction in accordance with Applicable Law.

22.7 International Users

  • Aerocruitment recognises that Users may be located in different countries.
  • Nothing in this section is intended to deprive a User of mandatory consumer, privacy, or other statutory protections applicable to that User.

SECTION 23 — COMPLAINTS AND REPORTING

23.1 Reporting

Users may contact Aerocruitment to report:

  • Fraudulent Employers or Recruiters.
  • Misleading vacancy advertisements.
  • Suspected forged documents.
  • Unauthorised use of Candidate Documentation.
  • Privacy or security concerns.
  • Billing errors.
  • Suspected account compromise.
  • Other breaches of these Terms.

23.2 Investigations

Aerocruitment may investigate complaints, request supporting evidence, restrict relevant content, and take appropriate action.

23.3 No Guaranteed Outcome

Aerocruitment will assess reports reasonably but does not guarantee that every complaint will result in a particular outcome.

23.4 External Rights

Nothing in this section restricts a User's right to report suspected unlawful activity to an appropriate authority or exercise a statutory complaint right.

SECTION 24 — CHANGES TO THE TERMS

24.1 Amendments

Aerocruitment may update these Terms to reflect changes in the Platform, its services, applicable law, or business operations.

24.2 Advance Notice

Aerocruitment will give at least 30 days' advance notice of material changes by email or a prominent account notice, identifying the effective date and material changes. Shorter notice may apply where required by law or reasonably necessary to address urgent security or fraud risks; the reason will be explained where lawful.

24.3 Acceptance and Existing Users

Where legally effective, continued use after the notified effective date may constitute acceptance. Aerocruitment will obtain affirmative acceptance where required and keep appropriate acceptance records. A User who does not accept may stop using the Platform and close the account; Sections 12 and 13 govern outstanding subscriptions and Earnings.

Updated Terms do not by themselves expand permission to disclose previously uploaded documents. Before any wider disclosure, Aerocruitment will provide the relevant notice and obtain the authorisation and any separate consent required under Section 8 and Applicable Law. Optional consent must not be inferred solely from acceptance of these Terms.

24.4 Existing Transactions

Changes will not retrospectively remove contractual rights that have already accrued or alter existing obligations where doing so would be unlawful.

SECTION 25 — GENERAL PROVISIONS

25.1 Entire Agreement

  • These Terms, together with the applicable Privacy Policy and incorporated policies, constitute the agreement between Aerocruitment and the User concerning the subject matter addressed herein.
  • They supersede prior agreements on the same subject matter to the extent legally permissible.

25.2 Severability

If a provision is found invalid or unenforceable, it will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in effect where legally permissible.

25.3 No Waiver

Failure or delay in exercising a right does not necessarily constitute a waiver of that right.

25.4 Assignment

  • Users may not assign their rights or obligations under these Terms without Aerocruitment's prior written consent, except where such restriction is prohibited by Applicable Law.
  • Aerocruitment may assign its rights and obligations in connection with a corporate restructuring, merger, acquisition, or transfer of the relevant business, subject to applicable contractual and data protection requirements.

25.5 Independent Contractors

Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency relationship between Aerocruitment and a User unless expressly agreed otherwise in writing.

25.6 Force Majeure

Aerocruitment will not be responsible for a delay or failure to perform an obligation to the extent caused by circumstances beyond its reasonable control, subject to Applicable Law.

Such circumstances may include natural disasters, government action, regulatory changes, widespread telecommunications failures, cyber incidents, and other qualifying events.

This provision does not excuse obligations that cannot lawfully be suspended or excluded.

25.7 Notices

  • Aerocruitment may send notices to the email address associated with a User's account or through another permitted communication method.
  • Legal notices to Aerocruitment must be sent using the contact details provided in Section 26.

25.8 Electronic Agreements

Where legally permitted, electronic acceptance, electronic records, and electronic communications may be used to establish and administer the contractual relationship.

25.9 No Third-Party Rights

Except where expressly stated or required by Applicable Law, these Terms do not confer enforceable contractual rights on third parties.

25.10 Language

The English-language version governs interpretation where permitted by Applicable Law. This does not override mandatory language requirements or rights arising from a legally required translation.
